Two PDP Members Struggle For Certificate Of Return

Drama ensued on Friday at the Independent National Electoral Commission, Enugu, when two people presented themselves to collect the certificate of return for the Nsukka/Igboeze South federal constituency.
The News Agency of Nigeria reports that the two people, Mr Ikechukwu Ugwuegede and Dr Patrick Asadu, both members of the Peoples Democratic Party, were engaged in a legal tussle over the party’s candidacy for the election.
Asadu, a member of the House of Representatives, secured a ruling at the Federal High Court sitting in Abuja recognising him as the rightful candidate for the election.
Ugwuegede, however, appealed the ruling.
The two appeared at the INEC office during the presentation of certificates of return to the governor-elect and National Assembly members-elect but were denied the certificate.
Each of the candidates asked the national commissioner of the INEC, Dame Gladys Nwafor, to be allowed to collect the certificate but the commissioner declined.
Presenting the certificates, Nwafor, who is the INEC’s national commissioner for Enugu, Imo and Ebonyi states, urged the elected officials to fulfill their campaign promises to the people.
According to her, today is a very unique day for the INEC and the government of Enugu state.
“We are here to give certificates of return to whom the electorate has given the mandate to serve the people.
“It has not been an easy task for both the commission and the contestants. I call it a divine mandate to serve the people.
“Enugu State is one of the most peaceful states and I am happy to be associated with the state,” she said.
Meanwhile, the Enugu state House of Assembly has ordered the arrest of its accountant general, Paschal Okolie, for failing to show up before the House for the third time.

PDP CHAIRMAN SET TO JOIN APC

The hurricane of defections hitting the Peoples Democratic Party (PDP) assumed a serious dimension on Friday when the party’s former national chairman, Prince Vincent Ogbulafor, visited the national secretariat of the All Progressives Congress (APC) in Abuja.

Ogbulafor arrived at the secretariat at about 2.35pm, and went into a closed door meeting with the APC national chairman, Chief John Oyegun.
The meeting lasted for about 40 minutes.
It will be recalled that as sitting PDP national chairman, Ogbulafor scored a first when he boasted in 2008 that the PDP would rule Nigeria for 60 years.
The phrase later became a maxim for party members even in the last presidential election campaign.
But it was not long before things fell apart between the Abia state-born politician and President Goodluck Jonathan as a result of a statement credited to him before the 2011 general elections that power must remain in the north till 2015.
The statement was seen as an affront to Jonathan who, though he was serving out the term of his former boss, the late President Umaru Musa Yar’Adua also haboured ambitions for 2011.
Ogbulafor was later forced to resign and then faced court for several years over charges of financial embezzlement.
Coming out of the APC office, Ogbulafor was accosted by journalists who enquired the reason for his mission at the opposition office.
Responding, Ogbulafor said he was at the secretariat to congratulate the APC national chairman for “a job well done”.
He said that for the first time, a political party has produced a Nigerian president in the person of General Mohammadu Buahri.

Ondo Residents Flee As Death From Strange Disease Rises

Many residents of Ode Irele, the headquarters of Irele Local Government area of Ondo State, are now fleeing the town following the rise in the number deaths from the strange ailment that hit the state on Wednesday Thisday reports.
The Ondo state government on Friday confirmed that 17 people had died from the disease, an increase from the 12 that were originally confirmed. Some sources said the death toll resulting from the disease was as high as 30.
While the government said the cause of the ailment was not known, other sources from the community blamed the death on some people that defiled the  shrine of the community deity known as Malokun.
Governor Olusegun Mimiko stated that the government had put necessary machinery in motion to control the disease. He said samples collected did not show that the victims died of the dreaded Ebola Virus Disease (EVD).
Mimiko, who said the state had witnessed  a major health challenge said the causative agents, diagnosis and cure are also yet to be determined.
He also added that he was saddened by  the losses and the attendant fear of what looks like an epidemic, he said the government can only bring words of consolation to the families of the deceased just as he assured the people of the state of the government’s resolve to find solution.
Mimiko said amidst conflicting and confusing information, the investigating team of experts sent by government to the area gathered that all the casualties died within hours of affliction. In all, 17 deaths have been confirmed in Ayadi Community and Ode Irele township and all the
deaths were preceded by symptoms of sudden blurred vision, headache and loss of consciousness.
“It must be said that the team was despatched to the communities affected and the General Hospital as well as other health facilities, to gather needed information about the nature, scope and circumstances of the outbreak.
“I must state that the symptoms in this situation are not peculiar to any known epidemic and so have remained largely confounding.
“Specifically, it must be stressed, the symptoms observed in the two communities of Ayadi and Ode Irele bear no resemblance to those associated with the Ebola Virus Disease (EVD)”, he said.
A similar mysterious ailment also claimed the lives of 5 students of Kanta Unity College, Argungu, Kebbi State.

What led to the beat down started with an argument between B-Red (Davido’s cousin and HKN artiste), and MC Galaxy. MC Galaxy claimed he was more popular than B-Red. The HKN act disagreed to the statement saying he was more popular than MC Galaxy. The back and forth continued for while till Deekay, a Ghanaian act on HKN said MC Galaxy was not funny as a comedian.
MC Galaxy took exception to this and this led to insults. Davido came in on the argument and told MC Galaxy to leave the studio because he did not like him insulting his artistes.
“David didn’t like that Galaxy was yabbing his boys and asked him to leave. Before Galaxy could react, David hit him on the back. Then his driver, Lati, took over, punching Galaxy and then hit him on the head with an Orijin bottle. B-Red didn’t touch Galaxy and Shizzi was very upset about what was happening in his studio and tried to stop the fight. Shizzi was really upset that Galaxy was attacked. If you see MC Galaxy’s eyes now” the source told Linda Ikeji.
MC Galaxy was contacted and he confirmed the assault happened. “Yes, I was attacked by Davido, his driver also broke a bottle on my head. Davido is someone I love and I am surprised he did this. His manager Kamal has called to apologize to me” said the singer.
In 2013, MC Galaxy featured Davido on his debut single ‘Nek Unek’.

Mimiko Speaks Of Misterious Disease Discovered In Ondo

Olusegun Mimiko, Ondo state governor, has disclosed that the symptoms observed in Ode-Irele, where a strange disease has broken out, bear no resemblance to those associated with Ebola or any known epidemic disease.

Channels TV reports that Mimiko made the statement during a statewide broadcast on the strange ailment, which has killed 27 people in Ondo state.
The government has started investigations in conjunction with development partners, the World Health Organisation. According to the report sent to the Nigeria Centre for Disease Control, there are no new cases of the ailment in the last 48 hours and none in the hospital.
Mimiko said that trained volunteers for active surveillance and case management have been deployed, while advocacy and sensitization efforts are ongoing in print and on electronic media. He further added that the final laboratory results of cerebro spinal fluid, blood and urine specimens of victims taken for examination are being awaited as this would help in surmounting the challenge as soon as possible.
The governor called on the people of the state to adhere to strict demands of hygiene such as regular washing of hands and covering of mouths while sneezing.

Residents of Ode-Irele GA disclosed that the ailment had appeared in the area three days ago. While health experts still cannot find out the cause of the disease, those affected pass away within one day after developing the symptoms. The neurologic clinical symptoms include blindness, and loss of consciousness. 

Akwa Ibom Election Results Will Not Be Reversed, Says INEC

Regardless of protests and violence, the Resident Electoral Commissioner in Akwa Ibom State, Barrister Austine Eni Okojie, has said that he cannot reverse the results of the April 11th, 2015 governorship and house of assembly elections as announced by the commission.

He made his position on the general elections in the state known Thursday night at the presentation of certificates of return to elected candidates of the 2015 general elections in the state held at the State INEC office, Uyo Akwa Ibom State capital.
The REC said those who are aggrieved over the results released by the commission should approach the tribunal to seek redress.
“Section 75 sub 1 of the electoral act 2010 as amended empowered the commission to issue a sealed certificate of returns of an election in a prescribed form within seven days to every candidate who won an election under this act.
“The essence of section 75 sub 1 of the electoral act 2010 as amended is to validate and give legal approval to the declaration of the candidate by the electoral umpire winner of the said election.
“Another justification for the issuance of certificate of return is to forestall a situation where two or more person will claim to be winner of the said election.
“The implication is that once the election is conducted and the result is declared the commission becomes fonctus officio.
“This is the same spirit with section 68 sub 1c of the electoral act 2010 as amended which provided that a declaration as made if a candidate is returned by the returning officer, it is only the tribunal or court of law that can upturn the decision.
“In the light of the above, I urge all those who participated in the conduct of the election and they are not satisfied with the outcome to please follow the part of honor and act in accordance with the provision of law by approaching the tribunal”, he maintained.
He however advised those who emerged victorious to be magnanimous in victory and extend the hands of fellowship to their opponents.
Presenting the certificates of return to the winners, the INEC National Commissioner, Mrs. Thelma Iremiren reminded them that there was a lot of ground to cover and expectation high.
Iremirn who is in-charge of Cross River, Akwa Ibom and Cross River States said since leadership comes with a lot of responsibility they should not forget to fulfil their campaign promises.
Responding on behalf of the elected members in the state, the Governor-elect, Udom Emmanuel lauded INEC officials who worked assiduously to ensure peace and credible governorship and house of assembly polls in the state.
“We have accepted this certificate of returns from INEC as an undisputed and uncontroversial mantle and symbol of victory at April 11 election”, he said.
He called on those who lost the election to learn from the exemplary way of President Goodluck Jonathan who accept defeat even before the official result was announced.
“We are also waiting for those that we defeated in the state to also show that spirit of sportsmanship and be good losers and come out straight with a sound message of congratulation for coming out victories in such keenly contested elections.
“As I therefore receive this mantle to prosecute he divine mandate for Akwa Ibom State I want to really assure all of us that we will work together as a team”, he said.
Meanwhile, following the mayhem that occurred in the Governorship and State House of Assembly elections in Akwa Ibom state, the governor-elect of the PDP, Mr. Udom Emmanuel had promised to welcome egalitarianism when sworn in on May 29.n

A video has surfaced showing Nigerian pastor, T.B. Joshua, warning South Africans of a “youth revolt” in their nation which would result in deaths of “certain people”.
The clip, uploaded to Joshua’s popular YouTube channel Emmanuel TV, says the controversial cleric prophesied about the deadly xenophobic attacks spreading across South Africa on Sunday 28th July 2013.
“In the nation, South Africa, we should help them in prayer because I am seeing youth revolt,” the clip quotes Mr. Joshua as saying. “It will be very serious. A situation where youth will come out and… you learn that there is a protest. Some people were killed – certain people.”
Mr. Joshua’s prediction made the front cover of South African newspaper-based City Press newspaper in August 2013 when Julius Malema, the fiery leader of South Africa’s Economic Freedom Fighters (EFF), visited his church in Nigeria for “spiritual blessings”.
The clip was posted alongside a message from Mr. Joshua to South Africans.
“If we fail to see that there are powers that cause people to be bowed down in bondage, we are going to fight the wrong battle,” he wrote, in a statement posted on the Nigerian pastor’s official Facebook page, followed by over 1.5 million people.
He then proceeded with a prayer for “calmness” in South Africa. “I pray for my nation, South Africa. As Jesus stood in the boat and commanded the storms to be calm, I stand in the midst of the storm in my nation, South Africa and I command the storm, wind and waves to be calm, in the name of Jesus! I speak calmness to my nation, South Africa, in the name of Jesus!”
The recent spate of xenophobic violence has spread to different South African cities, with thousands of foreign-owned shops forcibly closed and their owners seeking refuge in makeshift camps.
Five immigrants are said to have been killed, including a 14 year-old boy. Horrifying images and videos have surfaced online showing locals burning foreign nationals and looting their shops.
The violence erupted shortly after a purported statement from the Zulu King, Goodwill Zwelithini, calling on foreigners to return to their countries as they were causing economic “inconvenience” to locals.

Why Lamido May Leave N11 Billion Debt For His Successor

Governor Sule Lamido of Jigawa State has explained why he will be leaving N11 billion liability to the incoming government on May 29.
The governor while assenting to the state’s 2015 Appropriation Bill in Dutse yesterday, April 17, explained that the liability was part of the N17 billion used to construct an airport in Dutse which was sourced from the budget of different sectors.
According to Premium Times, Lamido said the Federal Government which promised to refund the money used to construct the airport in the state only paid N6 billion out of the money.
He said: We took the money from the state budgetary allocation from other sectors to build an airport within shortest period of time.
“We used the money where we think are useful and needed especially to get the airport started, with the intention of recovering it from the Federal Government but it was not forthcoming.
“This had affected our ongoing projects which we could not complete like in health sector and road projects.”
The governor said he was sorry for not fulfilling the promise made to the people to work within the available resources without leaving any debt.
He urged the Governor-elect, Badaru Abubakar, to follow-up the money promised by the Federal Government.
Jigawa state which was previously ruled by the Peoples Democratic Party  (PDP) fell to APC in the April 11 gubernatorial election.
The All Progressives Congress  governorship candidate for Jigawa State, Alh Mohammed Badaru Abubakar, won the governorship election overwhelmingly, polling 648,045 votes, while his closest opponent,  Alhaji Aminu Ibrahim Ringim  of the PDP  polled 479,447.

Wike speaking on Wednesday morning during “Focus Nigeria” on African Independent Television, AIT boasted that if the governorship election were to be conducted again by the Chairman of the Independent National Electoral Commission, INEC, Prof. Attahiru Jega or even by Ban-ki Moon, the United Nations Secretary General, he would still win by a landslide.
Wike according to Post Nigeria explained that the Rivers people were tired of the Amaechi-led APC government in the State saying the people did the needful last Saturday by coming out en masse and using their votes to end the tyranny of the APC in Rivers State.
“The good people of Rivers State are tired of the All Progressives Congress in the state due to their anti-people polices.
“I am telling you, even if Jega comes from Abuja to conduct the election, or Banki-moon from the United Nations, it could have been hard for APC to win the election in Rivers State,” he said.
Wike revealed the the people of Rivers voted the PDP because they werre sad that they had lost the presidential candidate to the PDP.
He said; “after the presidential elections, it was clear that the APC would lose the governorship seat, because of the anger the Rivers people had that they had lost the presidential elections.
“This is because President Jonathan has spent a greater part of his life in Rivers State and he also married form Rivers state. He is attached to Rivers state.
“So it is natural that the people will not be happy that their son lost the election.”
Rotimi Amaechi had on Saturday said that the gubernatorial election in Rivers State was a sham and called for the cancellation of the entire exercise. However, Wike disclosed that although there were minor skirmishes, the election was free and fair.

Wike in an earlier interview had asked Amaechi to emulate President Goodluck Jonathan who conceded defeat in the last presidential election.

PDP Assures APC Of Constructive Opposition

The Peoples Democratic Party vowed to provide credible opposition to the All Progressives Congress, without propaganda, insults and lies.
Olisa Metuh, PDP national publicity secretary, said on April 16, Thursday, at an FRCN political programme that their party would never insult either the president or the acting office.
He was quoted as saying by Daily Post:
“The PDP is a political party built on values, tradition and utmost respect for democratic tenets. Our manifesto and ideology center on national peace, stability and prosperity and we shall uphold this at all times. In this wise, the PDP as always, will continue to work in the general interest of the Nigerian people.
“We will not resort to insults, blackmail and lies with the aim to distract or ridicule the person or office of the President. However, we must state in very strong terms that we will not allow them to lead the nation astray. So we will firmly oppose any anti-people policy and programmes as may be introduced by the APC.
“We will do this by presenting sound alternatives in such a manner that Nigerians will be the utmost beneficiaries especially on issues that will lead the nation in the path of national unity and development.”
Regarding the recently concluded governorship and State Assembly elections in the country, Metuh lamented over the recorded irregularities which according to him were mostly against the PDP. Thus, the official raised alarm over the future of democracy in Nigeria under the APC-led administration.
Metuh vowed to take decisive actions and pursue PDP mandate in the areas where there were clear infractions against the PDP.

High Court Strengthens Sanitation Law In Lagos State

A Federal High Court in Lagos has rejected the enforcement of a judgment which stopped the Lagos State Government from imposing movement restriction on citizens during the monthly sanitation exercise in the state, Punch online reports
This new ruling means that anyone found moving between 7am and 10am on the last Saturday of the month, on the state or federal roads in Lagos, during the sanitation hours is liable to arrest.
The new order, made by Justice Mohammed Idris on Friday, put on hold the enforcement of a March 16, 2015 judgment which abolished the powers of  Lagos State and its agents to arrest anyone found moving during the sanitation exercise.
According to the judge, the March 16 judgment would not be enforced until the outcome of the appeal filed by Lagos State challenging the judgment.
Justice Idris, however, ordered the state to compile records of proceedings within 90 days otherwise the stay of execution would be voided.
The Lagos State Government, through its Solicitor General, Mr. Lawal Pedro (SAN), had filed an application for stay of execution, urging Idris to summarily suspend the enforcement of his judgment.
Idris had, on March 16,  declared the movement restriction policy as illegal and a violation of sections 35 and 41 of the Constitution, which preserved the citizens’ right to personal liberty and freedom of movement.
Though the judge did not overrule the sanitation exercise, he held that Lagos State and its agents lacked the legal backing to arrest or detain any citizen found moving during the exercise as there was currently no law to that effect.
“I have no doubt that the restrictions imposed on the movement of persons and sanctions meted out to those who breach them are clearly unsupportable in law and unjustified.
“I must state loud and clear that the environmental sanitation exercise is not in itself unlawful, but what is unlawful and unconstitutional is the restriction imposed by the respondents during the exercise,” Justice Idris was quoted as saying.
But Pedro, in a further affidavit, insisted that the judge did not consider or exhaust all the relevant provisions of the law before arriving at his judgment.
“We were able to show exceptional circumstances in our further affidavit; we exhibited a law, which, I must concede, was not brought to the attention of the court; the court would have been more comfortable while arriving at its judgment, if that law was brought before my Lord,” Pedro said on Thursday.
He made reference to and read Section 28 (1) and (2) of the amended Environmental Sanitation Edict of 1987, which empowered the police, a sanitary officer or a member of the then Military Task Force to arrest without a warrant, any person “found roaming about without lawful excuse within such specific period,” when any normal communal or other civic obligation directed by either the state or Federal Government was supposed to be observed.
Pedro further likened the movement restriction policy to what obtains during the general elections period, saying though he was not aware of any specific law that said movement must be frozen during elections, peculiar circumstances necessitated the policy.
In opposition, the respondent/applicant, Mr. Ebun-Olu Adegboruwa, appealed to the court to refuse the application for stay of judgment execution, saying Lagos State had a penchant for disregarding court judgments.
He said the state had been known for undermining the authority of the court and accused the state of deliberately delaying hearing in its own appeal against Idris’ judgment.
The monthly environmental sanitation exercise in Lagos State is for residents in the state to clean their environment.
In spite of calls from many Lagosians for the exercise to be scrapped, it has been observed in Lagos for decades.
With this latest development, only time will tell if the state government will be forced to change it stance on the policy.

8 Hours Without President: Falana Warns

Femi Falana, a legal luminary and Senior Advocate of Nigeria(SAN)  has warned against a lacuna that may be created in the absence of a President of the Federal Republic of Nigeria for 8 hours. He however advised President Jonathan to handover to the President-elect, General Mohammadu Buhari on the 28th of May 2015, instead of 28th as announced by the Minister of Information, Patricia Akwashiki.
Following the announcement by Patricia Akwashiki, minister of information, that President Goodluck Jonathan to hand over the power to president-elect, Muhammadu Buhari, on May 28, Nigeria will be without the leader at least for 8 hours.
It is an undeniable fact that the current leader of the country took oath of office and loyalty on the 29th May 2011 for a four years term; that would expired by constitutional effluxion of time on the 12am on the 29th May 2015.
President Jonathan does not need to prepare any handover notes for the incoming President. He may not even attend the ceremony of inauguration of the president-elect.
The person that is obligated by the Constitution of the Federal Republic of Nigeria to play the most important assignment on the day of the inauguration of the next President is the Chief Justice of Nigeria.
The Chief Justice of Nigeria is the person on whose responsibility lies on to administer the Oath of Office and Oath of allegiance prescribed by the Constitution of the Federal Republic of Nigeria on the president-elect.
Buhari will not be taking the oath of office until May 29; consequently Nigeria will have to survive at least 8 hours on autopilot.
On his turn, Femi Falana (SAN), human rights lawyer, speaking about this case said the new date was a deviation from the law as a vacuum would be created should Jonathan handover before Buhari’s swearing in.
As far as the law is concerned, President Jonathan is in charge of the country until May 29. He cannot cut short his presidency in the name of handing over the day before at a dinner, as there is no provision for a vacuum.”
May be it’s just a curious fact, but who will defend Nigeria should catastrophe strike during the 8 hour period?
We suppose that Chief Justice of Nigeria will be on president’s duties as he is considered to be the one to administer the swearing in of office for the president-elect.

“I pray the army boy will not take the advantage of the situation to overthrow government,” Salaudeen Kamaldeen said.
Mohammed Suraj urges president: “GEJ it’s obvious you and your team are up to something and we want you to know we are smarter than that, because we didn’t fall for your Orubebe kidnap trick to Jega. How can you hand over power 8 hours to the time set constitutionally for transition?”
On his turn, Akano Kabir said: “This interregnum of 8 hours leaves room for a thousand and one negative possibilities for this country. It could be used for military take over; it could be used by the militants who hither to had been empowered ammunition wise to declare war on us; it is enough time for the south south and south east to move for succession from Nigeria. Another possibility is that it could be calculated to be a time of respite to allow the corrupt officials of this government to abscond to seek asylum in other countries.”
Popoola Oluwaseyi Peter added: “Sincerely something dangerous it’s on their mind and all Nigerian must be watchful. Jonathan accepted the defeat with his last option to be activated.”
Lukman SuluQarnain supposes that GMB will automatically become acting president.
It should be noted that Buhari had defeated President Jonathan, the candidate of the Peoples Democratic Party in the March 28 presidential poll.
Jonathan has constituted a Transition Committee to midwife the handover of government from the present administration to the in-coming one.
